The 'Luv' rapper faces a minimum of nine years in prison as his legal team tries to delay the sentencing, which is set for June 13, by filing a motion to dismiss judge David Herriford.

AceShowbiz - Tory Lanez was defeated again in his attempt to escape from prosecution for the Megan Thee Stallion shooting case. His motion for a new trial was dismissed by a judge in court on Tuesday, May 9 despite his plea to the judge not to "ruin his life" the day before.
Meghann Cuniff of Los Angeles Public Press tweeted out from the courtroom, "Herriford went through the seven main arguments from Lanez's lawyers and dismantled each one. He concluded there were no errors. But he also said even if he concluded each error existed, the errors didn't have a material affect on the outcome of the trial to warrant a new trial."
According to the journalist, the judge concluded, "In the end, the jury believed the prosecution's case beyond a reasonable doubt." She reported that the judge "called out Lanez's lawyers for not mentioning any of the other evidence against Lanez when they focused on perceived problems with some evidence."
"The judge said his job is to look at all the evidence in the case, 'not cherry pick very small portions,' " the journalist reported. "He said the Instagram comment "that's not true" that Lanez's lawyers took issue with was really a very minor part of the trial."
The judge set June 13 at 10:30 A.M. as the time of the sentencing. In what Cuniff described as "a jaw-dropping move," Lanez's lawyers filed a motion to disqualify Judge Herriford from the case and argued that they didn't think the judge could issue his ruling until the motion was resolved. Judge Herriford disagreed, though.
Lanez is facing a minimum of nine years in prison. Deputy DA Alex Bott said after the hearing, "I think any time you point a gun at someone and pull the trigger five times, that's an action that could easily kill a person, and I think that's an action that should have serious consequences."
Meanwhile, Lanez's lawyer blamed his former attorney George Mgdesyan for failing the rapper due to lack of preparation time and claimed that the original 10-day trial "was a jumbled, bungled mess."
