The rapper and record producer has through his attorney Adamma McKinnon filed court documents seeking joint physical and legal custody of the 5-year-old girl, whom he shares with ex Eva Marcille. TMZ first broke the news.

In the documents obtained by the publication, Kevin claims that "The Real Housewives of Atlanta" star has not been allowing him to see his daughter since she moved to Georgia, Atlanta in October 2015. Not only revising their custody agreement, but the "Naked" musician also wants his daughter to take his last name again. Right now, Marley has the last name of Eva's current husband Michael Sterling.

As for the new custody agreement, Kevin seeks an appropriate child support and states that spending more time with Marley will "foster a parental bond."

A rep for Eva has issued a statement in response to the filing. "Kevin McCall was given an ample amount of time to petition any action and never did," so the statement read. "The documents speak for themselves and there will be no further comment on this matter at this time."

Eva and Kevin welcomed Marley in 2014, months before they split. Following her wedding with Michael Sterling, the "America's Next Top Model" alum changed her daughter's last name to Sterling. Explaining the reason during a radio interview, she said, "Long story short, we all have the name Sterling, and Marley is the only one with her biological father's name and I saw it necessary and Mike saw it necessary to change her name."

She continued, "We've been going through the process I must say, it is not an easy process and it is not the faint of heart but we've been working through it and [as of] yesterday I can say that thank you for the honorable Judge Manning here in Fulton County court granted me a name change for Marley. She is now officially and legally Marley Rae Sterling."
