Teresa Giudice's husband wants to be released from the ICE custody and return to his home country temporarily while awaiting decision on his deportation appeal.

AceShowbiz - Joe Giudice wants to be sent back to Italy, but only temporarily. On Tuesday, September 24, lawyers for the husband of Teresa Giudice filed documents in federal appeals court requesting his release from the custody of United States Immigration and Customs Enforcement (USICE) while awaiting decision on his deportation appeal.

"Giving the hardship to Mr. Giudice and his family from his continued detention, the balance of irreparable harm has shift and [Joe] has asked that the stay be lifted so that he could be released from USICE custody and returned to Italy during the pendency of this case," reads the request, obtained by People.

TMZ additionally reports that Joe asks to be released and wants to go back to his motherland so that he can work and provide for his family. According to his lawyer, Joe wants to "begin working and contributing financially to his wife and four young children."

Joe has been held at the Clinton County Correctional Center in Lock Haven, Pa. since he was released from federal prison in March 2019, after completing his 41-month sentence for mail, wire and bankruptcy fraud. He has appealed the deportation decision more than once, and is currently waiting for the final decision.

Recently, his request to be released on bail and return home in the States was denied by a judge. "Joe is extremely disappointed," James J. Leonard, the Giudice family attorney, said in a statement on Friday. "He spent the last six months in a cage not able to hug or kiss his wife or daughters when they came to visit him. We treat animals in shelters better than we treat human beings in these ICE facilities."

Teresa also reacted to the denied request for release on bail. "It's a sad time with my husband and everything, so we're going to try and work it out as best we can," she told Us Weekly. The star of "The Real Housewives of New Jersey" added, "The most important thing is our four daughters, so I'm hoping Joe is able to stay in the United States."
