The former 'How I Met Your Mother' star filed his own declaration against his neighbours after they requested an order of protection against him.

AceShowbiz - Actor Josh Radnor has scored a big victory in his legal battle with a neighbour - a judge has dismissed a temporary restraining order against him.

According to documents, obtained by The Blast, the former "How I Met Your Mother" star filed his own declaration against his neighbours after they requested an order of protection against him in an ongoing battle over a deck.

Last year, the actor was sued for allegedly overstepping the boundaries of a legal agreement between the previous owner of Radnor's house and the folks next door. The deal allowed the backyard decking on his property to encroach upon his neighbour's estate, as long as there was a retaining wall and walkway in place.

The neighbours claimed Radnor removed the wall and extended the decking in 2016, breaking the terms of the agreement. They obtained a temporary restraining order against the star after claiming he and his roommate yell at them when they are outside and intimidate workers on their property.

Radnor was ordered to stay seven yards away from his neighbours, but the ruling has now been overturned.

The actor told the court, "I have never shouted at any of the Andersons... (and) there is no other adult male living at my home. I sometimes have guests stay at my home when they are in town."

Radnor explained he rarely speaks to his neighbours and politely declined to engage in the conversation when they tried to bring up the litigation recently.

He also claims he has photographs of them scaling his wall, and accused them of making "false statements" about harassment, which he believes are damaging to his reputation.

The judge overseeing the case agreed with Radnor and terminated the restraining order.

There will be another hearing in September.
