AceShowbiz - Former Dave Matthews Band star Boyd Tinsley has fired back at allegations of sexual misconduct, insisting he will fight his accuser in and out of court.

The violinist has been accused of sending former protege James Frost-Winn disgusting, sexually suggestive texts, and masturbating next to him while he was asleep.

In a lawsuit filed on Thursday, May 17, Frost-Winn claimed he woke to find Tinsley pleasuring himself. The musician reportedly texted him to apologise, insisting he had "confused his pills".

Now Boyd is responding to the claims, stating, "These accusations have caused embarrassment for my family, my friends and my fans. I will fight both in and out of court to repair the damage that has been done."

In a statement to Billboard, Tinsley referenced an interview Frost-Winn gave to Consequence of Sound on Thursday, calling it a "one-sided account" and admitting he was "truly hurt" by the claims.

"I only wish the reporter had spoken to me first, so they would have heard the truth".

Tinsley announced plans to take a break from the Dave Matthews Band in February, so he could take care of "family and health" issues, but now it seems he won't be welcomed back.

A statement issued by the group on Thursday reads: "Though Boyd is no longer a member of the band, we are shocked by these disturbing allegations and we were not previously aware of them".

Earlier this week, bandleader Matthews commented on his colleague's decision not to join the group on its upcoming tour, telling Vulture, "I have a deep love for Boyd. He has to deal with his stuff. In many ways I'm sure it would've been a lot easier for him to just say, 'I'm good. Let's go play', but you can't just throw yourself away, your wellness away, because you play violin in a band. It doesn't make any sense to do that".
