AceShowbiz - Art curator and Heidi Klum's ex-boyfriend Vito Schnabel was busted earlier this month at Burning Man for possessing Psilocybin, which is also known as psychedelic mushrooms. According to docs obtained by TMZ, Vito was arrested September 3 by Pershing County Sheriffs and charged with distribution and manufacture of a controlled substance, a felony.

The report says Vito pleaded not guilty. He could face up to five years if convicted.

Apparently, Vito was one of the 70,000 who descended on Black Rock City, Nevada this year for the annual bacchanal among tech CEOs, mogul and celebrities like Paris Hilton, Alessandra Ambrosio, Diplo and Scott Eastwood.

The art curator was held on $5,000 bond and was released the same day. A statement from Pershing County Justice Court read, "The Defendant did willfully, unlawfully import, transport, sell, exchange, barter, supply, prescribe, dispense, give away or administer a controlled or counterfeit substance and manufacture or compound a controlled or counterfeit substance."

"On or about September 3, 2017, at or near 10 and Deep Playa of the Burning Man Event... the Defendant did transport to Black Rock City, Psilocybin, a schedule one controlled substance," they added.

This comes on the heels of Vito and Heidi calling it quits after together for three years. After rumors of the two taking time apart surfaced in mid this month, the 44-year-old model confirmed their split to PEOPLE. "I believe that it is important to take time to pause and reflect," she told the publication.

The pair were last photographed together on August 20. A month before, the son of artist Julian Schnabel was pictured smooching another woman. He was spotted in an embrace with the mystery brunette in the early hours of the morning in London.

Speaking to PEOPLE, Vito said of the kiss, "The claims that have been made are a misinterpretation of an entirely innocent situation," explaining that "there is nothing more to this than I was simply saying goodnight to a family friend and we went on our separate ways."
