A judge in Pennsylvania decided on Tuesday, April 21 to list Shepard as the legal mother of a baby born via surrogate with her estranged husband on the baby's birth certificate.

AceShowbiz - Sherri Shepherd was named the legal mother of a baby boy born via surrogate with her soon-to-be-ex-husband Lamar Sally. A judge in Pennsylvania decided on Tuesday, April 21 that the comedienne's name was to be officially listed as the baby's mother in his birth certificate.

Since the 8-month-old Lamar Sally Jr was born, Sally and Shepherd had been in a legal battle after Shepherd changed her mind about the surrogacy and no longer wanted to be the mother of the baby.

Sally's lawyer, Tiffany Palmer, confirmed the settlement on Tuesday. "Justice was served," so Palmer said. "The court found that the baby has two legal parents and those people are the two people who conceived him, Lamar Sally and Sherri Shepherd."

"The court upheld what we believe is and should be the law in Pennsylvania," Palmer further claimed. "If you set out to conceive a child through assisted reproduction and enter into contracts to do so, you cannot just walk away from your legal parental responsibility because you changed your mind."

Sally considered the battle "bittersweet" and said that he wasn't really pleased with the decision. "I'm glad it's over, but I feel sad what it had to come to," he said outside courtroom on Tuesday. "Now I can go back to L.A. and tend to my son."

While Shepherd didn't appear in the court and her lawyer refused to comment, the baby's legal representative Craig Bluestein was satisfied. "I feel very good," said Bluestein. "I think little LJ, who is not yet 1 year old, needed some protection. Justice was served today."
